<lb n="0537c22" ed="T"/>以手等而行殺害；或持刀<anchor xml:id="beg_26" type="star"/>授<anchor xml:id="end_26"/>與者，知他欲自
<lb n="0537c23" ed="T"/>殺，便以刀等置傍；或自持刀者，謂己無力，但
<lb n="0537c24" ed="T"/>自執刀，令彼傍人扶手行殺；或求他人令持
<lb n="0537c25" ed="T"/>刀殺。語謂欲令他死行勸讚等，於不樂死則
<lb n="0537c26" ed="T"/>勸喩令死。若願死者，則讚歎令死，言：「何用此
<lb n="0537c27" ed="T"/>罪累等？」者，說：「壽存過重、死後福多。」言不淨者，
<lb n="0537c28" ed="T"/>託不淨成故。名不淨惡活者，勝人所棄故。言
<lb n="0537c29" ed="T"/>死勝生者，欲令他歡喜故。隨自心念者，我勸
<pb n="0538a" ed="T" xml:id="T24.1458.0538a"/>
<lb n="0538a01" ed="T"/>他死當招福德。以餘言說者，非但說此，更以
<lb n="0538a02" ed="T"/>別言而相勸讚。言彼因死者，顯非餘事，但由
<lb n="0538a03" ed="T"/>勸死令他命斷，得波羅市迦；若不死者，得窣
<lb n="0538a04" ed="T"/>吐<anchor xml:id="nkr_note_orig_0538001" n="0538001"/><anchor xml:id="nkr_note_mod_0538001" n="0538001"/><anchor xml:id="beg0538001" n="0538001"/>羅<anchor xml:id="end0538001"/>。先興方便遣殺他人，後起悔心不欲其
<lb n="0538a05" ed="T"/>死，前人雖死，但得窣吐羅。言斷命成犯者，謂
<lb n="0538a06" ed="T"/>因而致死。</p><p xml:id="pT24p0538a0605" cb:place="inline">此中犯者，謂是苾芻以內身或外
<lb n="0538a07" ed="T"/>甎等、或復兩俱如執刀等、或以毒藥、或爲坑
<lb n="0538a08" ed="T"/>穽、或將諸酒及以餘藥令彼心亂、或作呪
<lb n="0538a09" ed="T"/>術遣他迷惑、或作發機、或於崖塹樓臺危險
<lb n="0538a10" ed="T"/>之處推令墮落、或於水火怖難惡處詭設
<lb n="0538a11" ed="T"/>方便遣向其中、或於寒夜露地令凍。人女人
<lb n="0538a12" ed="T"/>男及扇<anchor xml:id="nkr_note_add_0538a1201" n="0538a1201"/><anchor xml:id="beg0538a1201" n="0538a1201"/>侘<anchor xml:id="end0538a1201"/>等作有命想，或復生疑起害方便，
<lb n="0538a13" ed="T"/>因茲致死，皆他勝罪；若不死者，得窣吐羅。或
<lb n="0538a14" ed="T"/>起全屍、或起半屍，令害前境，得罪輕重隨境
<lb n="0538a15" ed="T"/>應知。此有別者，如若彼二返害苾芻，由先方
<lb n="0538a16" ed="T"/>便，得窣吐羅。若苾芻害彼屍鬼，得二麁罪。若
<lb n="0538a17" ed="T"/>害化形，亦得麁罪。若於母無害、胎有殺心，<anchor xml:id="nkr_note_orig_0538002" n="0538002"/><anchor xml:id="nkr_note_mod_0538002" n="0538002"/><anchor xml:id="beg0538002" n="0538002"/>蹂<anchor xml:id="end0538002"/>
<lb n="0538a18" ed="T"/>踏母腹，若胎死非母，得他勝罪；母死非胎，
<lb n="0538a19" ed="T"/>但得麁罪；若二俱死，波羅市迦；若俱不死，窣
<lb n="0538a20" ed="T"/>吐羅罪。如是應知，於母殺心非於胎子，准前
<lb n="0538a21" ed="T"/>可識。於人女腹有傍生胎及非人胎，故心墮
<lb n="0538a22" ed="T"/>者，便得麁罪。於傍生腹知有人胎，或知人趣
<lb n="0538a23" ed="T"/>變作傍生，斷彼命時俱得本罪。若變己身爲
<lb n="0538a24" ed="T"/>傍生狀，害他人時有苾芻想，亦得本罪。欲害
<lb n="0538a25" ed="T"/>餘人<anchor xml:id="nkr_note_orig_0538003" n="0538003"/><anchor xml:id="nkr_note_mod_0538003" n="0538003"/><anchor xml:id="beg0538003" n="0538003"/>誤<anchor xml:id="end0538003"/>害父母及阿羅漢，得<anchor xml:id="nkr_note_orig_0538004" n="0538004"/><anchor xml:id="nkr_note_mod_0538004" n="0538004"/><anchor xml:id="beg0538004" n="0538004"/>窣<anchor xml:id="end0538004"/>吐羅罪。由
<lb n="0538a26" ed="T"/>於父等無殺心故；非阿羅漢作羅漢想，或是
<lb n="0538a27" ed="T"/>羅漢作非羅漢想，父母亦然。或於母等爲殺
<lb n="0538a28" ed="T"/>方便，自在前死並得麁罪。有女遺胎，餘女拾
<lb n="0538a29" ed="T"/>取內於己腹，若殺後母，不得逆罪；若出家
<pb n="0538b" ed="T" xml:id="T24.1458.0538b"/>
<lb n="0538b01" ed="T"/>時應問後母。若人作人想及以生疑，皆得本
<lb n="0538b02" ed="T"/>罪。若於非人作人想疑殺，得麁罪。若人作傍
<lb n="0538b03" ed="T"/>生想，得惡作罪；作非人想，亦得惡作。有情被
<lb n="0538b04" ed="T"/>趁，苾芻見時殺想吿他，隨事成犯。於衆多人
<lb n="0538b05" ed="T"/>一有害心誤殺餘時，窣吐羅罪。無記心中，
<lb n="0538b06" ed="T"/>但得惡作。作戲笑心而爲打<anchor xml:id="nkr_note_orig_0538005" n="0538005"/><anchor xml:id="nkr_note_mod_0538005" n="0538005"/><anchor xml:id="beg0538005" n="0538005"/>拍<anchor xml:id="end0538005"/>，因斯致死，
<lb n="0538b07" ed="T"/>得惡作罪。未近圓時已興方便，近圓之後方
<lb n="0538b08" ed="T"/>始命終，兩種四句准前應作。若起方便，遣
<lb n="0538b09" ed="T"/>使行殺，轉根爲尼，亦得本罪。若二根生，得前
<lb n="0538b10" ed="T"/>麁罪。退爲求寂，亦同麁罪。下諸學處<anchor xml:id="nkr_note_orig_0538006" n="0538006"/><anchor xml:id="nkr_note_mod_0538006" n="0538006"/><anchor xml:id="beg0538006" n="0538006"/>准<anchor xml:id="end0538006"/>事應

<lb n="0538b21" ed="T"/>不順其語，或爲療疾因卽命終，此皆無犯。若
<lb n="0538b22" ed="T"/>於病者無有殺心，然所陳說令其樂死，或時
<lb n="0538b23" ed="T"/>持刀、或以繩索不審思察安病人邊，或安毒
<lb n="0538b24" ed="T"/>藥，皆得惡作。</p><p xml:id="pT24p0538b2406" cb:place="inline">無智之人不令瞻病，設有急事
<lb n="0538b25" ed="T"/>要須看者，應可善敎極令存意。病人報言：「莫
<lb n="0538b26" ed="T"/>扶我起。」強扶令起，若彼死者，得窣吐羅。於餘
<lb n="0538b27" ed="T"/>威儀類<anchor xml:id="nkr_note_orig_0538020" n="0538020"/><anchor xml:id="nkr_note_mod_0538020" n="0538020"/><anchor xml:id="beg0538020" n="0538020"/>斯<anchor xml:id="end0538020"/>應識，若<anchor xml:id="nkr_note_orig_0538021" n="0538021"/><anchor xml:id="nkr_note_mod_0538021" n="0538021"/><anchor xml:id="beg0538021" n="0538021"/>涉<anchor xml:id="end0538021"/>路時扶輿病者，准此
<lb n="0538b28" ed="T"/>應知。吿病者云：「先洗方起。」因卽命過，此雖無
<lb n="0538b29" ed="T"/>犯，然不應爲有重病人共輿而去，因致死者

<lb n="0538c01" ed="T"/>無犯，此亦不應造次輿去。或看病者情生勞

<lb n="0538c04" ed="T"/>與不宜者，看病之人亦得麁罪；若無別可得

<lb n="0538c09" ed="T"/>凡治病時應問醫者；若無醫人，問解醫苾芻；

<lb n="0538c26" ed="T"/>爾者，得惡作罪。凡被傷人勿與醋飮，見他食

<lb n="0539b17" ed="T"/>能獲故。又釋云：「寂靜者，謂是涅槃，離衆煩惱

<lb n="0539c21" ed="T"/>人，已學三藏故；我得無所有，無長衣鉢故；我
<lb n="0539c22" ed="T"/>是最後生，望前生說故；我是豫流，入河水故；
<lb n="0539c23" ed="T"/>我已得果，謂得讀誦果故、或得菴沒羅果；我
<lb n="0539c24" ed="T"/>離五怖，無過去怖故；我斷煩惱，無過去惑故；
<lb n="0539c25" ed="T"/>佛聲聞衆所應獲事我已得之，謂阿笈摩等
<lb n="0539c26" ed="T"/>法及能善修諸根：我是大師，解說法故；我是
<lb n="0539c27" ed="T"/>佛陀，善覺惡事故；我是毘鉢尸佛聲聞弟子，
<lb n="0539c28" ed="T"/>於諸佛邊盡歸依故。」說斯等語，內有詐情矯
<lb n="0539c29" ed="T"/>陳密說，並窣吐羅罪。若無別意如言而說，自

<lb n="0540a05" ed="T"/>說餘果等。」類此應知：「我於今日不得俗定，過
<lb n="0540a06" ed="T"/>斯妙定亦復未得。我於某處獲得初定，然實
<lb n="0540a07" ed="T"/>不與覺分相應。」自書己名云：「得道果。」便報他
<lb n="0540a08" ed="T"/>云：「此作書人道，我得聖果。」此等皆得窣吐羅

<lb n="0540a14" ed="T"/>就斯座，遂便默然，受其所請。他或吿曰：「仁
<lb n="0540a15" ed="T"/>是婆羅門不？」答云：「我是能除衆罪故。或於六
<lb n="0540a16" ed="T"/>根善防護故。」「若是羅漢應取食食。」默然而受，
<lb n="0540a17" ed="T"/>皆窣吐羅罪，於去來等准此應說。又有釋云：
<lb n="0540a18" ed="T"/>「言所陳事以身相表，問時默然得他勝罪。」對
<lb n="0540a19" ed="T"/>人人想、或復生疑，他領解時便得本罪。對非
<lb n="0540a20" ed="T"/>人說時，作人想疑，得窣吐羅罪。無人有人
<lb n="0540a21" ed="T"/>想、或時入定、或他眠睡、或對無知、或他不領
<lb n="0540a22" ed="T"/>解倉卒而說，並得窣吐羅罪。無犯者，如聖者

<lb n="0540c09" ed="T"/>方便、或捉或搦，作受樂心欲出不淨，若出者，
<lb n="0540c10" ed="T"/>僧伽伐尸沙；不出者，得窣吐羅。覺爲方便，夢
<lb n="0540c11" ed="T"/>中流泄，或復翻此作心受樂；或前興方便，後
<lb n="0540c12" ed="T"/>乃息心；或作方便，其精欲動卽便攝念，皆
<lb n="0540c13" ed="T"/>得麁罪。言欲動者，謂精未離本處，卽此無間
<lb n="0540c14" ed="T"/>不淨當流，雖精未流已有變狀。或在身中而
<lb n="0540c15" ed="T"/>泄出者，謂精已轉動離於本處。或故作舞樂、
<lb n="0540c16" ed="T"/>或空裏搖身、或由打築、或因摩按、或以藥揩
<lb n="0540c17" ed="T"/>癢、或逆流動根、或揩氈褥、或石木甁等、或於
<lb n="0540c18" ed="T"/>肉團故流不淨，並窣吐羅罪；若不泄者，皆得
<lb n="0540c19" ed="T"/>惡作。若於頭<anchor xml:id="nkr_note_orig_0540018" n="0540018"/><anchor xml:id="nkr_note_mod_0540018" n="0540018"/><anchor xml:id="beg0540018" n="0540018"/>項<anchor xml:id="end0540018"/>耳鼻及餘身分，或於靑脹膿

<lb n="0540c21" ed="T"/>中流泄。若捉他生支故出不淨，或時量度自
<lb n="0540c22" ed="T"/>己生支，或手捉搦爲樂摩觸故令興起，並得
<lb n="0540c23" ed="T"/>窣吐羅罪。若有染心看自生支，得惡作罪。

<lb n="0540c28" ed="T"/>抱持，此皆無犯。若多欲者聽畜皮囊羊鹿等

<lb n="0541a11" ed="T"/>是纏，應爲四句：第一句者，謂心生染著；第
<lb n="0541a12" ed="T"/>二句者，謂於前境起愛縛心；第三句者，二事
<lb n="0541a13" ed="T"/>俱有；第四句者，謂除前相。女人者，謂可共交
<lb n="0541a14" ed="T"/>會，於彼身分復無傷損。手謂腕前。臂謂腕
<lb n="0541a15" ed="T"/>後。髮謂頭髮及繫髮衣。此中犯者，先有染心、
<lb n="0541a16" ed="T"/>堪行婬女，一一身分復無衣隔，於其九事悉
<lb n="0541a17" ed="T"/>皆有犯，謂觸、極觸、憑、捉、牽、曳、上、下、遍抱。觸謂

<lb n="0541a21" ed="T"/>遍抱卽是總急抱持。若苾芻於女人處，爲斯
<lb n="0541a22" ed="T"/>九事作受樂心，咸得衆敎。若擬行不淨行，雖
<lb n="0541a23" ed="T"/>無衣隔觸彼女身，得窣吐羅罪。若一身壞、若
<lb n="0541a24" ed="T"/>二俱壞、若身多癬疥、若欲觸此而<anchor xml:id="beg_2d" type="star"/>誤<anchor xml:id="end_2d"/>觸彼、
<lb n="0541a25" ed="T"/>若以髮毛爪齒而觸髮毛爪齒及乾枯骨、若
<lb n="0541a26" ed="T"/>復生疑爲此爲彼、若觸入滅盡定苾芻尼、若

<lb n="0541a29" ed="T"/>羅等罪、或波羅市迦罪。苾芻觸男，彼轉成女，

<lb n="0541b01" ed="T"/>得衆敎罪。或時自轉或二俱轉，得罪同前。想
<lb n="0541b02" ed="T"/>轉不轉及尼觸女男，罪有重輕隨事廣說<anchor xml:id="end0541006"/>。如
<lb n="0541b03" ed="T"/>是應知，無堪小女、丈夫、半擇迦，無物隔者，並
<lb n="0541b04" ed="T"/>窣吐羅罪。若有物隔幷傍生類，咸得惡作。人
<lb n="0541b05" ed="T"/>女人女想，若復生疑，染意觸時，並得本罪。非
<lb n="0541b06" ed="T"/>人女人女想疑，<anchor xml:id="beg_2e" type="star"/>吐<anchor xml:id="end_2e"/>羅。人女非人女想，惡作
<lb n="0541b07" ed="T"/>罪。二形之人若女強者，得僧伽伐尸沙。若異
<lb n="0541b08" ed="T"/>此者，但得麁罪。母女、姊妹作受樂心觸彼身
<lb n="0541b09" ed="T"/>時，亦得麁罪，由羞慚境樂想不生；若無羞
<lb n="0541b10" ed="T"/>慚卽得本罪。若於女根以脚指蹴，若土瓦打，

<lb n="0541b18" ed="T"/>之。若見女人被水漂溺，自有力者應可救濟，
<lb n="0541b19" ed="T"/>勿生染念，作母女想而牽取之。若被溺人不

<lb n="0541c13" ed="T"/>惡言自體及因皆是雜染，現是鄙穢當墮惡
<lb n="0541c14" ed="T"/>趣故。共相者，謂作不軌言軌則，上人之所棄
<lb n="0541c15" ed="T"/>故，共知是非法。自相者，婬欲相應之言。譬

<lb n="0542a10" ed="T"/>他作鄙惡之語，若遣使、若傳說、若書印、手印、
<lb n="0542a11" ed="T"/>若言：「汝根缺壞是罪惡物，可共我交，與我同
<lb n="0542a12" ed="T"/>臥，汝之所愛可共分張。」然此不與鄙惡之字
<lb n="0542a13" ed="T"/>葉婆合說，若對入滅定尼、若吿彼云：「姊妹！
<lb n="0542a14" ed="T"/>與我葉縛。」女人解意。若見苾芻尼著好衣服，
<lb n="0542a15" ed="T"/>作如是語：「姊妹汝著婬服，欲覓丈夫。」若言：「少

<lb n="0542b19" ed="T"/>最、勝、殊、妙、賢、善、應供、可愛、廣博、極最、極勝、極

<lb n="0543c14" ed="T"/>己欲樂，若草若木而自求覓。言營作小房者，
<lb n="0543c15" ed="T"/>若自作、若使人。無主者，謂無別人與之爲主。
<lb n="0543c16" ed="T"/>爲己作者，非爲僧伽。當應量者，煩勞廢業不
<lb n="0543c17" ed="T"/>令傷大，恐迮致患不容過小。言長佛十二張
<lb n="0543c18" ed="T"/>手、廣七張手者，計佛十二張手長中人十八

<lb n="0543c26" ed="T"/>此應與。造房苾芻應向本處從衆乞觀，若合
<lb n="0543c27" ed="T"/>衆俱往、若差別人去，不應遙信便不親撿。旣
<lb n="0543c28" ed="T"/>觀無妨，應對衆前白言：「大德！應知彼處房地
<lb n="0543c29" ed="T"/>我已觀訖，應法淸淨，宜可知時。」應先作白次
